TERMS AND CONDITION

This document sets forth the legally binding Terms and Conditions ("Terms") governing the use of the Snap N Fix platform (the "Platform"), owned and operated by Snap N Fix Pty Ltd (ABN: 46 668 512 445) ("Snap N Fix", "we", "us", or "our"). By accessing, downloading, or using the Platform (including the website, mobile application, and any associated services), the user ("you", "your", "Customer", or "Provider") agrees to be bound by these Terms.

1. Definitions

Unless the context otherwise requires, the following terms have the meanings set out below:

  • "Platform": The Snap N Fix website, mobile application, and associated services.
  • "User": Any individual or entity accessing or using the Platform.
  • "Customer": A User who posts a request for automotive services via the Platform.
  • "Provider": A User who offers, provides, or completes automotive services via the Platform.
  • "Engagement": An agreement between a Customer and a Provider for the performance of services.
  • "Services": Automotive repair, inspection, maintenance or similar services offered by Providers.
  • "Content": All data, text, images, files, and other information made available on or through the Platform.

2. Acceptance of Terms

By accessing or using the Platform, you acknowledge and agree that:

  • You have read, understood, and accepted these Terms.
  • You are at least 18 years of age or have appropriate legal capacity.
  • You have authority to enter into a binding agreement, either on your own behalf or on behalf of an organisation.

If you do not agree with any part of these Terms, you must immediately cease use of the Platform.

3. Nature of the Platform

Snap N Fix operates as a neutral facilitator that enables Customers to post service requests and receive quotes from independent Providers. Snap N Fix:

  • Is not a party to any Engagement or service contract between Customer and Provider.
  • Does not warrant the quality, legality, reliability, safety, or performance of any Services.
  • Does not vet or guarantee the qualifications, licensing, insurance or background of any Provider.

Snap N Fix disclaims all liability arising out of or in connection with any Engagement.

4. User Accounts and Access

4.1 Registration:

Users must register for an account to access the Platform's core functionality. By registering, you represent and warrant that all information provided is true, accurate, and complete.

4.2 Account Security:

You are solely responsible for maintaining the confidentiality of your login credentials. You accept full liability for any activity undertaken through your account.

4.3 Termination:

We reserve the right, in our absolute discretion and without prior notice, to suspend or terminate any account for conduct that violates these Terms, is harmful to the Platform, or is otherwise unlawful.

5. User Conduct and Obligations

You agree:

  • Not to use the Platform for any unlawful, fraudulent, or harmful purpose.
  • Not to submit false, misleading, defamatory, obscene, or otherwise objectionable content.
  • Not to engage in abusive, harassing, or threatening conduct.
  • Not to post any Job or Service that contravenes applicable laws or regulations.
  • To comply with all applicable local, state, and federal laws and regulations when offering or performing Services.

6. Engagements and Service Contracts

6.1

All service contracts formed via the Platform are strictly between the Customer and the Provider. Snap N Fix is not a party to such agreements and assumes no responsibility or liability in connection with any aspect of the Services.

6.2

Customers and Providers are solely responsible for negotiating the scope, pricing, timing, and deliverables of any Engagement.

6.3

Providers warrant that they hold any required qualifications, certifications, licenses, and insurance necessary to lawfully perform the Services.

6.4

Snap N Fix is not responsible for monitoring the execution or fulfilment of any Engagement, nor for resolving disputes between Users.

7. No Performance Guarantee

7.1

SnapnFix is a platform designed to connect users with automotive service providers. While the App facilitates the submission of quote requests and service inquiries, SnapnFix makes no representation, warranty, or guarantee that:

  • You or your business will receive a specific number of leads per day, week, or month;
  • Any lead received via the App will convert into a job, sale, or paying customer;
  • You will achieve any minimum level of revenue, profit, or business growth from participation on the platform.
7.2 User Responsibility

It is solely your responsibility to:

  • Review, follow up, and manage all leads or quote requests received;
  • Negotiate and finalise any service engagement with customers independently;
  • Ensure your own business success, profitability, and compliance with applicable laws and regulations.
7.3 Platform Role and Limitation

SnapnFix acts only as a facilitator of communication between users and service providers. The App is not a contractor, agent, employer, or representative of any user or business listed on the platform.

7.4 No Liability for Conversion or Revenue Loss

SnapnFix, its directors, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or special loss or damage (including loss of revenue, business opportunities, or anticipated savings) arising from:

  • Failure to receive a desired number of leads;
  • Leads that do not result in successful bookings or payments;
  • Business decisions made based on the availability or expectation of leads through the App.
7.5 No Refund or Credit

Unless otherwise stated in a separate agreement, SnapnFix does not offer refunds or credit based on the quantity or quality of leads, nor for any lack of conversion into actual jobs or sales.

8. Fees, Payments, and Refunds

8.1 Platform Fees:

Snap N Fix may charge service, transaction, or platform fees, which will be clearly disclosed prior to transaction.

8.2 Payment Facilitation:

Snap N Fix may act as a limited payment collection agent on behalf of Providers solely for the purpose of accepting and remitting payments.

8.3 Refunds:

Refunds may be issued only in accordance with our Refund Policy and subject to applicable Australian Consumer Law. Snap N Fix does not guarantee any refund once a transaction has been completed, unless compelled by law.

8.4 Taxes:

Users are solely responsible for determining and remitting any applicable taxes (including GST) arising from their use of the Platform or provision of Services.

9. Dispute Resolution Between Users

9.1

Snap N Fix does not mediate or resolve disputes between Users. You acknowledge that any dispute arising out of a service engagement is solely between the Customer and the Provider.

9.2

Snap N Fix may, at its sole discretion, provide dispute assistance or information to regulatory authorities, but is under no obligation to intervene.

10. Limitation of Liability

To the maximum extent permitted by law, Snap N Fix:

  • Excludes all representations, warranties, guarantees and conditions not expressly set out in these Terms.
  • Disclaims all liability for any direct, indirect, incidental, special, consequential or punitive loss, including but not limited to lost profits, loss of data, personal injury, property damage, or business interruption.
  • Shall not be liable for any damages arising from your reliance on or use of any Content or Services obtained through the Platform.

You acknowledge that you use the Platform at your own risk.

11. Indemnification

You agree to indemnify, defend and hold harmless Snap N Fix, its directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use or misuse of the Platform;
  • Your breach of these Terms;
  • Any content submitted or posted by you;
  • Any claim or dispute between you and another User.

12. Intellectual Property

All intellectual property rights in the Platform, including but not limited to trademarks, software, content, graphics, and code, are owned by or licensed to Snap N Fix. You may not copy, reproduce, distribute, modify or create derivative works without prior written consent.

13. Privacy and Data Protection

Snap N Fix's collection and handling of personal information is governed by our Privacy Policy and complies with the Privacy Act 1988 (Cth). By using the Platform, you consent to the collection, use, and disclosure of your personal information as set out in our Privacy Policy.

14. Platform Availability and Modifications

Snap N Fix does not warrant that the Platform will be uninterrupted, secure, or error-free. We may suspend or discontinue any aspect of the Platform at any time without notice for maintenance, upgrades, or other reasons.

We reserve the right to modify, amend, or update these Terms at our sole discretion. Continued use of the Platform after any such changes constitutes acceptance of the revised Terms.

15. Termination by User

You may terminate your account at any time by providing written notice to Snap N Fix. Upon termination, you remain liable for any obligations incurred prior to termination.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, and you irrevocably submit to the exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.

17. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, along with the Privacy Policy and any additional terms or guidelines incorporated herein by reference, constitute the entire agreement between the parties regarding the subject matter hereof, and supersede any prior written or oral agreements.
